1. Purpose
These requirements apply to every gaming, casino, sports betting, lottery and other game-of-chance operator ("Operator") that uses TokenPe. They form part of the TokenPe Terms of Service and the Acceptable Use Policy. TokenPe works only with licensed Operators.
2. Licensing
2.1 You must hold a valid licence for every product you offer, in every jurisdiction where you offer it.
2.2 We accept licences issued by the following authorities, subject to our review of each licence:
- CuraƧao Gaming Authority
- Malta Gaming Authority
- Isle of Man Gambling Supervision Commission
- Kahnawake Gaming Commission
- Anjouan Offshore Finance Authority
- US state gaming regulators, for operations in that state
2.3 We may accept other licensing authorities after review, or decline any licence at our discretion.
2.4 You must give us a copy of each licence, the licence number and the licensed entity's name. The licensed entity must be the TokenPe merchant, or a company we have approved in its group.
2.5 You must tell us within 2 business days if a licence is suspended, revoked, not renewed, or made subject to conditions, or if a regulator starts an investigation or enforcement action against you.
3. Markets and players
3.1 You may accept players only from jurisdictions where your licence allows it and where your products are lawful.
3.2 You must not accept US players unless you hold a licence from the US state where the player is located, for the product offered, and the transaction is lawful in that state.
3.3 You must use geolocation, IP blocking and KYC controls to stop players in jurisdictions where you are not licensed, and in the prohibited jurisdictions listed in our AML/KYC & Sanctions Policy.
3.4 You must tell us which markets you serve and tell us before you enter a new market.
4. UIGEA
4.1 TokenPe does not process restricted transactions as defined in the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA) and Regulation GG.
4.2 You confirm that you do not and will not use TokenPe to receive funds in connection with unlawful internet gambling, as defined in the UIGEA.
4.3 If you serve US players under a state licence, you must give us evidence of that licence and of your controls that keep US activity within the licensed state, and confirm that your US activity is lawful.
4.4 We may end our relationship immediately if we find that you are processing restricted transactions through TokenPe.
5. Player protection
- Block players under 18, or under the higher minimum age required where you operate.
- Verify the identity of players in line with your licence and the law.
- Offer responsible gaming tools, such as deposit limits, time-outs and self-exclusion, and honour self-exclusions.
- Display clear terms, including bonus terms, and your licence details on your website.
- Do not market to minors or self-excluded players.
6. AML controls
- Maintain an AML programme that meets your licence and the law, including player KYC, source of funds checks for high-value players, transaction monitoring and suspicious activity reporting to your regulator or financial intelligence unit.
- Do not let players use your platform to move money without genuine play.
- Use per-player deposit addresses or payment references so that every transaction can be linked to a player.
- Give us player-level transaction information when we request it, as the law permits.
7. Payouts and card network rules
- Fiat payouts through our Mastercard partnership are available only where Mastercard transfers are supported and where gaming payouts are allowed by our payout partners and card network rules.
- You must follow any registration or other requirements of our payout partners and card network rules for gaming merchants, including those for merchant category code (MCC) 7995.
8. Onboarding documents
When you apply, you must provide:
- company documents and ownership details, as required by our AML/KYC & Sanctions Policy;
- copies of all gaming licences;
- a list of websites, brands and markets;
- your AML, KYC and responsible gaming policies;
- your terms and conditions for players;
- a description of your geolocation and age verification controls;
- expected monthly volumes and payout volumes.
9. Ongoing review
We review every Operator at least once a year and whenever a licence, market or risk changes. We may ask for updated documents and may test your website and controls.
10. Consequences of breach
If you breach these requirements, we may hold funds as allowed by law, suspend services, close your account and report to the authorities.
